The law allows the right of a PREEMPTIVE strike, up to and including the use of deadly force, IF the threat is clear, present, and a sufficient threat to warrant that action. Undesirable, but allowed. It would be unlikely that Magneto would be detained for any extended period, let alone charged.. -Defensive Tactics / Use of Force Consultant
