How come HAMMER agents who were just doing their job and believed Norman Osborn was sanctioned by the President in his assault on Asgard sent to jail for treason by the righteous Captain America, but Victoria Hand - someone completely aware of and assisted almost every single heinous thing Osborn was involved in - gets immediately let off on good will to instead be an Avenger by the righteous Captain America?

Presumably, any HAMMER agents who went to prison were guilty of actual criminal acts, no matter how sanctioned they may have believed Norman Osborn to have been.
