How much leeway do you think Stan Lee would have if he decided he wanted to return to active Marvel writing duties? Like if he wanted to write a major series in mainstream continuity, could he just go do that? (P.S.: Pun not intended!)

Stan would have as much or as little leeway as any other Marvel writer.
