It is a valid question though with a character like the Joker, he keeps escaping and he keeps murdering people and then he gets locked up again. Is Batman doesn't end the danger that the Joker poses to the people of Gotham is he really protecting the citizens? At this stage I don't think he is, but I agree with you, Batman can't kill but that means the two characters are just going to be locked in a loop with so satisfying culmination for the readers. Maybe that's what the joker finds so amusing
it is not Batman’s job or responsibility to kill the Joker. And if the state, the system, determines through the legal system that his crimes do not warrant the death penalty for whatever reason, well, that’s how the system works.
Plus, what satisfying culmination for the readers do you expect to get? Batman has been published for 75 years, and will likely be published for 75 more. There isn’t going to be a great final Batman story until well after you and I are dead in the ground, if ever.
