If Dugan didn't have the Infinity Formula himself then the flashback scene in Remender's Captain America #13 where Iron Nail attacks him and Fury makes no sense.

Not at all. That scene took place in 1966. If Dum Dum was in his thirties during WWII, then he would have been in his fifties in that scene–which seems to be right on the money to me.
